Resolution No. 452\/26<\/a>, which amended provisions of Resolution No. 355\/23, reinforcing the institutional role of Labour Justice in the prevention, identification, and suppression of electoral harassment practices in labor relations.<\/p>\nUnder the terms of the new resolution, electoral harassment is defined as “any form of distinction, exclusion, or preference based on political conviction or opinion within the scope of labor relations, including the hiring process, exercised within the context of the exercise of political rights provided for in the Constitution of the Republic.”<\/p>\n
On the other hand, the rule clarifies that electoral harassment is not considered to be participation, support, manifestation, propaganda, or the exercise of voting in elections aimed at choosing union leaders, worker representatives, members of the Internal Commission for Accident and Harassment Prevention (CIPA), the Commission of Employee Representatives, or other labor representation bodies of a similar nature, which are subject to their own legal regime.<\/p>\n
The main innovation introduced by the resolution consists of the obligation for labor magistrates to ex officio notify the Public Labour Prosecutor’s Office (MPT) and the Electoral Public Prosecutor’s Office (MPE) whenever, upon receiving a labor lawsuit, they identify allegations that, in theory, may characterize electoral harassment. In such cases, they must forward a copy of the initial petition and relevant documents to the competent bodies. In addition, the Regional Internal Affairs Offices of the Regional Labour Courts will monitor, on a monthly basis, cases classified with the specific electoral harassment marker.<\/p>\n
Ultimately, the above measures aim to mitigate this specific form of harassment to guarantee workers the exercise of their constitutional right to a free and secret vote and freedom of conviction.<\/p>\n
For companies, care must be doubled both in curbing practices of this type on their premises and in virtual\/electronic channels under their responsibility (corporate communication tools, work WhatsApp groups) and in not promoting political acts, which could be interpreted as electoral harassment within the concept above.<\/p>\n
Furthermore, the need is reinforced for employers to avoid the dissemination of materials or manifestations of a political-partisan nature that are interpreted as an attempt to influence workers’ freedom of choice, and to implement effective, widely publicized reporting channels that ensure the anonymity of whistleblowers and reduce the company’s exposure to labor and reputational risks.<\/p>\n
